DEFINITIONS 1.1 "Software" means the CanvasXpress JavaScript distribution (the canvasxpress browser bundle and files distributed with it), in source or compiled form. 1.2 "You" means the individual or legal entity exercising rights under this License. 1.3 "The Mark" means the CanvasXpress attribution notice the Software renders on its output (the on-canvas watermark and any equivalent attribution the Software emits). 1.4 "Commercial License" means a separate paid agreement from CanvasXpress that grants the right to suppress the Mark. 1.5 "License Key" means a credential issued by CanvasXpress (including any domain-bound token) that, when validly present, suppresses the Mark. 2. GRANT OF RIGHTS (COMMUNITY TIER) Subject to Section 3, CanvasXpress grants You a worldwide, royalty-free, non-exclusive license to use, copy, modify, and distribute the Software and works built with it, for any purpose including commercial purposes, at no charge. 3. CONDITIONS 3.1 Attribution. The Mark the Software renders must remain visible and unaltered in all output the Software produces. You must not remove, hide, obscure, resize into illegibility, reposition off-canvas, recolor to match the background, disable, or otherwise defeat the Mark by any means -- in the source, at build time, or at runtime -- unless You hold a current Commercial License. 3.2 No circumvention (technological protection measure). The License Key check and the Mark-rendering code together constitute a technological protection measure ("TPM") that controls access to the un-marked form of the Software. You must not disable, bypass, circumvent, remove, spoof, decrypt, descramble, or otherwise defeat that TPM, and you must not manufacture, distribute, or make available any product, code, service, or information primarily designed or produced to do so, whether performed in the source, at build time, or at runtime. Forging, sharing, or reusing a License Key beyond its issued scope is a material breach and an act of circumvention. The parties acknowledge that this TPM is protected by anti-circumvention law, including 17 U.S.C. Section 1201 (U.S. DMCA) and Article 6 of Directive 2001/29/EC (EU) and their equivalents, and that circumvention gives rise to statutory remedies in addition to any remedy for breach of this License. 3.3 No reverse engineering (with interoperability carve-out). You must not reverse assemble, reverse compile, or reverse engineer the Software, or cause a third party to do so, for the purpose of defeating the TPM in Section 3.2 or removing the Mark. This Section 3.3 does not prohibit, and nothing in this License restricts, reverse engineering that is permitted by applicable non-waivable law -- including decompilation for interoperability under Article 6 of Directive 2009/24/EC (EU Software Directive) -- to the extent such reverse engineering is not used to circumvent the TPM or remove the Mark. 3.4 Notices. You must retain this License text, the copyright notice, and the disclaimer in all copies or substantial portions of the Software. 3.5 No misrepresentation. You must not remove or alter the origin of the Software or represent it as your own original work, and you must not use the CanvasXpress name or marks to endorse products derived from the Software without permission. 4. COMMERCIAL LICENSE (MARK SUPPRESSION) The right to suppress the Mark is not granted by this License and is available only under a Commercial License. A valid License Key issued under a Commercial License suppresses the Mark automatically; this is a permitted exercise of that License and is not a breach of Section 3. Commercial Licenses may be scoped (per developer, per domain, per term) as stated at purchase. 5. TERMINATION If You breach Section 3, the rights granted under Section 2 terminate automatically. They are reinstated prospectively if You cure the breach within 30 days of becoming aware of it. A Commercial License, if held, governs its own termination. 6. RELATIONSHIP TO OTHER CANVASXPRESS DISTRIBUTIONS This License covers only the JavaScript Software. The CanvasXpress packages for R and Python are licensed separately under LGPL-3.0-or-later and are not subject to the attribution or Mark-suppression terms here. 7. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
